1. About Luna Tails

These Terms of Service apply to purchases made through lunatailsco.nl and to the use of the Luna Tails online store.

Luna Tails is a sole proprietorship registered in the Netherlands.

Luna Tails operates online only. The business address is not open for customer visits.

By placing an order, you agree to these Terms and to the policies referenced in them.

2. Products

Luna Tails sells curated pet celebration products, including personalised Birthday Boxes.

We aim to describe and display our products accurately. Colours and appearance may vary slightly depending on screen settings, and certain products, colours or designs included in a Birthday Box may vary depending on your selected preferences and product availability where this is disclosed in the product description.

Where availability requires a substitution, Luna Tails may use a comparable product consistent with the nature and intended quality of the Birthday Box. This does not affect your statutory rights if the order supplied does not conform to the agreement.

3. Personalisation

Birthday Boxes are individually personalised using information supplied by the customer, including the cat’s name and age.

You are responsible for checking personalised information carefully before placing your order.

An error that results solely from incorrect information supplied by the customer does not make the product defective. This does not affect your rights where Luna Tails makes an error in carrying out the personalisation.

4. Prices and payment

All prices shown to consumers on the Luna Tails webshop include applicable VAT.

Shipping costs and any other applicable charges are shown before you place your order.

Available payment methods are displayed during checkout.

The price applicable to your order is the price displayed when the order is placed, subject to correction of an obvious technical or pricing error where permitted by law.

5. Orders and formation of the agreement

When you complete checkout and submit an order with an obligation to pay, you place an order with Luna Tails.

You will receive an electronic order confirmation at the email address provided during checkout.

Luna Tails may refuse or cancel an order where there is a legitimate reason, for example if a product cannot be supplied, there is an obvious technical or pricing error, or there is reasonable suspicion of fraud or misuse.

If Luna Tails cancels an order after payment has been received, the amount paid for the cancelled order will be refunded.

6. Right of withdrawal and cancellations

Each Luna Tails Birthday Box is individually personalised with the cat’s name and age and prepared specifically for that order.

Because the Birthday Box is a clearly personalised product, the statutory 14-day right of withdrawal does not apply to the personalised Birthday Box.

You may nevertheless submit a cancellation request while your order has not yet been fulfilled. Because preparation and personalisation may begin shortly after ordering, cancellation cannot always be guaranteed.

7. Delivery

Luna Tails currently delivers within the Netherlands using the delivery methods offered during checkout.

Available shipping methods, shipping costs and estimated delivery dates are shown before the order is placed.

For deliveries arranged through Luna Tails, Luna Tails remains responsible for the goods until they are delivered to you or another recipient designated by you, in accordance with applicable consumer law.

8. Statutory consumer rights

Products supplied by Luna Tails must conform to the purchase agreement and meet the standards that consumers may reasonably expect.

If an item is damaged, defective, incomplete, incorrect or otherwise does not conform to the agreement, you retain your statutory consumer rights.

Depending on the circumstances, an appropriate remedy may include repair or replacement free of charge or, where the problem cannot adequately be resolved, a full or partial refund.

Nothing in these Terms excludes or limits mandatory statutory consumer rights.

We will review complaints and respond within a reasonable period.

10. Accounts and acceptable use

Where customer accounts are available, you are responsible for providing accurate information and for keeping access to your account secure.

You may not use the website or Services for unlawful or fraudulent purposes, interfere with the security or proper operation of the website, introduce malicious software, or attempt to gain unauthorised access to the store or customer information.

11. Intellectual property

Unless otherwise stated, the Luna Tails name, logo, website design, original text, photographs, graphics, videos and other original Luna Tails content are owned by Luna Tails or used with the permission of the relevant rights holder.

You may use the website for normal personal shopping purposes. You may not reproduce, distribute, commercially exploit or substantially copy Luna Tails-owned content without permission, except where permitted by law.

12. Third-party services and links

The Luna Tails website may use or link to services operated by third parties, such as payment providers, shipping providers or external websites.

Those third parties may have their own terms and privacy practices. Luna Tails is not responsible for the content or operation of independent third-party websites.

This does not affect Luna Tails’ responsibilities as the seller for your purchase from Luna Tails.

13. Relationship with Shopify

Luna Tails is powered by Shopify, which provides the ecommerce platform used to operate the store.

Purchases made from the Luna Tails store are contracts directly between you and Luna Tails. Shopify is the ecommerce platform provider and is not the seller of Luna Tails products.

14. Privacy

Personal data is processed in accordance with our Privacy Policy and Privacy & GDPR Information.

Shopify also processes certain information in connection with providing the ecommerce platform, as explained in those privacy notices.

15. Changes to these Terms

Luna Tails may update these Terms where reasonably necessary, for example because of changes to our services, business practices or applicable law.

The version applicable to an order is the version that applied when that order was placed. Changes will not retrospectively reduce mandatory rights relating to an existing order.

16. Governing law

These Terms and agreements with Luna Tails are governed by Dutch law.

This choice of law does not deprive consumers of mandatory consumer-protection rights that apply to them under applicable law.
